Thank you for choosing Resort Style Properties!

These Terms of Service (“Terms”) are a binding legal agreement between you and Resort Style Properties that govern your right to use the websites, applications, and
other offerings from Resort Style Properties (collectively, the “Resort Style Properties Platform”). When used in these Terms, “Resort Style Properties,” “we,” “us,” or “our” refers to the Resort Style Properties entity. Resort Style Properties is a management company offering the short-term tenancy (“Accommodations”) of housing to “Guests” from around the world. You must register an account to access any of the features of the Resort Style Properties Platform, and must keep your account information accurate. Resort Style Properties reserves the right to refuse service to anyone prior to and during their Accommodations, and to evict any Guest from any Accommodation at any time.

1. Payments
Congratulations on your reservation! Your payment method will be charged as soon as your reservation is confirmed by our management team. The charge will show up under the name Resort Style Properties. Upon completing your reservation, 50% of the total invoice is charged up front, and the remaining balance is due no later than fourteen (14) days prior to your arrival date. You may contact us to make payments prior to this date, otherwise, your method of payment will be charged automatically fourteen (14) days prior to your arrival date. In the event that your method of payment fails to process or is declined, we reserve the right to cancel the entire reservation, without refund of your previous payments, if the full remaining payment is not received within 24 hours from the time we notify you via email about the balance due. Please maintain access to your emails throughout your reservation period. Any reservation created within 14 days of arrival requires full payment at the time of your reservation confirmation.

2. Cancellation Policy
Before you book, make sure you are comfortable with our cancelation policies set forth. Please keep in mind that cancellations due to COVID-19, illness and/ or travel
disruptions adhere to these same policies:

Full Refund Policy: Cancel within 48 hours of your booking confirmation by sending an email to [email protected] for a full refund.

50% Refund Policy: Cancel by 1 week prior to your scheduled check-in time and
receive a 50% refund of your reservation total.

No Refund Policy: Cancel within 1 week of your check-in time and date and receive no refund of your reservation.

3. Bookings
When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees, taxes, and any other items identified during checkout (collectively, “Total Price”). You are also agreeing that Resort Style Properties, via Stripe Payments, may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect any remaining balances when due, and Damage Claim amounts. When you receive the booking confirmation, a contract for accommodations (a “Reservation”) is formed directly between you and us. In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to booking a Listing.

An Accommodation Reservation is a limited license to enter, occupy, and use the Accommodation. Resort Style Properties retains the right to re-enter the Accommodation during your stay, to the extent that: (i) it is reasonably necessary, and (ii) it is consistent with applicable law. If you stay past checkout, the we have the right to make you leave in a manner consistent with applicable laws, such as, but not limited to, forced eviction, loss of Guest access to the property, and removal of personal property, in addition to imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests stated at the time of your reservation, or therein modified afterwards with us.

4. Properties
All properties are managed and maintained to the best of our ability, and are equipped with basic household essentials, not including food & water. Resort Style Properties makes no guarantees or offers any warranties on guest experiences. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation. For example, this means: (i) you are responsible for leaving an Accommodation (and related property) in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Claim amounts necessary to cover damage that you, your guest(s), or your pet(s) cause to an Accommodation, and (iii) you must act with integrity, treat others with respect, and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to an Accommodation, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to any Accommodation or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate an Accommodation to determine whether it is suitable for you. For example, Accommodations may carry risk of illness, bodily injury, disability, or
death, and you freely and willfully assume those risks by choosing to participate in booking on this Platform.

5. Rules

5.1 House Rules:

  • Please respect the property as if it were your own. If you see something that needs management attention, please inform us in a timely manner.
  • Quiet Hours begin at 10:00 PM in most areas of Southern California (9:00 PM in the city of Thousand Oaks). All guests must be mindful not to make loud or obnoxious noises such as yelling, screaming, splashing, music, etc. following the city’s mandatory Quiet Hours. For more information on this, please ask us, or visit the city’s website of the accommodation you are visiting.
  • No cigarette smoke is allowed indoors of any property.
  • We request that dishes be washed or left in the dishwasher running upon check-out.
  • We request that towels be thrown into the washing machine and run upon check-out. Bedding may remain on the beds.
  • We request that trash bags be thrown into either the blue or black trash collection
    bins, usually on or near the street.
  • Once again, Quiet Hours are generally between 10:00 PM – 8:00 AM. Some properties are between 9:00 PM – 7:00 AM. Please check the House Rules for the property you are booking.

5.2 General Rules:
You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect
  • Do not lie, misrepresent something or someone, or pretend to be someone else.
  • Be polite and respectful when you communicate or interact with others.
  • Do not discriminate against or harass others.
  • Do not scrape, hack, reverse engineer, compromise or impair the Resort Style Properties Platform
  • Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Resort Style Properties Platform.
  • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Resort Style Properties Platform or Content.
  • Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Resort Style Properties Platform.
  • Do not take any action that could damage or adversely affect the performance or proper functioning of the Resort Style Properties Platform.
  • Only use the Resort Style Properties Platform as authorized by these Terms or
    another agreement with us
  • You may only use another Member’s personal information with permission as necessary to facilitate a transaction using the Resort Style Properties Platform
    as authorized by these Terms.
  • Do not book Accommodations unless you are actually using the Accommodations.
  • Honor your legal obligations
  • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
  • If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
  • Read and follow our Terms & Conditions.
  • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.
  • Do not use the name, logo, branding, or trademarks of Resort Style Properties
    or others without permission.
  • Do not use or register any domain name, social media handle, trade name,
    trademark, branding, logo, or other source identifier that may be confused
    with Resort Style Properties branding.

5.3 Parties & Events Rules:

We do not allow:

  • Any sort of disruptive gathering at any property, regardless of number of people.
  • Open-invite gatherings
  • Disturbances to the community such as:
  • Excessive noise
  • Congregating in the front of the property
  • Soliciting neighbors
  • Causing traffic congestion
  • Illegal parking
  • Illegal dumping or collecting trash in undesignated area
  • Trespassing or vandalism to ours or neighboring property or possessions

6. Privacy Policy

6.1. Definitions

Undefined terms in this Privacy Policy have the same definition as in our Terms of Service (“Terms”).

6.2. Personal information we collect

6.2.1 Information needed to use the Resort Style Properties Platform.

We collect personal information about you when you use the Resort Style Properties Platform. Without it, we may not be able to provide all services requested. This information includes:

  • Contact Information, Account, Profile Information. Such as your first name, last name, phone number, postal address, email address, date of birth, and profile photo, some of which will depend on the features you use.
  • Identity Verification and Payment Information. Such as images of your government issued ID (as permitted by applicable laws), your ID number or
    other verification information, bank account or payment account information. If you are not a Resort Style Properties member, we may receive payment
    information relating to you, such as when a Resort Style Properties member provides your payment card to complete a booking. When a copy of your ID is
    provided to us, we may scan, use, and store information contained in your ID to verify your identity.

6.3. HOW WE USE INFORMATION WE COLLECT
6.3.1. Provide, Improve, and Develop the Resort Style Properties Platform. Such as to:

  • Enable you to access the Resort Style Properties Platform and make and receive
    payments,
  • Enable you to communicate with us,
  • Process your request,
  • Provide customer service, training,
  • Send you messages, updates, security alerts, and account notifications,
  • Send you promotional messages, emails, marketing, advertising, and other information based on your preferences and social media advertising through social media platforms,
  • Comply with law, respond to legal requests, prevent harm, and protect our rights
  • Enforce our Terms and other policies
  • Enforce the Payment Terms and other payment policies
  • Provide and improve Payment Services.
  • We do not sell or share your information with third parties.

7. Liabilities, Warranties and Indemnification
7.1 Limitations on Liability.
Neither Resort Style Properties (including its affiliates and personnel) nor any other
party involved in creating, producing, or delivering the Resort Style Properties Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Resort Style Properties Platform or any Content or Accommodations, or (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Resort Style Properties Platform.

Except for our obligation to collect and process payments under these Terms, in no event will Resort Style Properties’, or Accommodations’, aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the Resort Style Properties Platform, or any Content or Accommodations exceed: (A) to Guests, the amount you paid as a Guest during the 12-month period prior to the event giving rise to the liability, (B) to anyone else, one hundred U.S. dollars (US$100). These limitations of liability and damages are fundamental elements of the agreement between you and Resort Style Properties.

7.2 Indemnification
To the maximum extent permitted by applicable law, you agree to release, defend (at
Resort Style Properties’ option), indemnify, and hold Resort Style Properties (including other affiliates, properties and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies or Standards, (ii) your improper use of the Resort Style Properties Platform, (iii) your interaction with any Member, or stay at an Accommodation, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.

7.3 Mandatory Pre-Arbitration Dispute Resolution and Notification At least 30 days prior to initiating an arbitration, you and Resort Style Properties each agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. You must send your notice of dispute to Resort Style Properties by mailing it to Resort Style Properties’ agent for service:

Resort Style Properties will send its notice of dispute to the email address associated with your Resort Style Properties account. A notice of dispute must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (available at www.adr.org) with the AAA and providing a copy to the other party as specified in the AAA Rules (available at www.adr.org).

7.4 Agreement to Arbitrate
You and Resort Style Properties mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Resort Style Properties Platform, or any Content (collectively, “Disputes”) will be settled by binding individual arbitration (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Resort Style Properties agree that the arbitrator will decide that issue.
